The Nigerian Electricity Regulatory Commission (NERC) invites experienced and competent service providers to submit an expression of interest for the Establishment of a Quality Management System to Obtain ISO Certification. Interested service providers should possess relevant qualifications and experience.




Nigerian Electricity Regulatory Commission (NERC) is an independent regulatory body with authority for the regulation of the electric power industry in Nigeria. NERC was formed in 2005 under the Obasanjo administration’s economic reform agenda through the Electric Power Sector Reform Act, 2005 (repealed), now the Electricity Act 2023 for the formation and review of electricity tariffs, transparent policies regarding subsidies, promotion of policies that are efficient and environmentally friendly, and also including forming and enforcing of standards in the creation and use of electricity in Nigeria. NERC was instituted primarily to regulate the tariff of Power Generating companies owned or controlled by the government, and any other generating company which has a licence for power generation and transmission of energy, and distribution of electricity.

The Commission wishes to invite experienced and competent service providers to submit an expression of interest for the underlisted service:

Title: Expression of Interest (EoI) for the Engagement of a Professional Services Firm to Facilitate the Establishment of a Quality Management System to Obtain ISO Certification

Introduction
  • The Nigerian Electricity Regulatory Commission ("the Commission" or "NERC") was established by the Electric Power Sector Reform ("EPSR") Act 2004, which has subsequently been repealed by the Electricity Act ("EA 2023" or the "Act") of 2023.
  • NERC is mandated by the Act to oversee the Nigerian Electricity Sector and ensure efficient industry operation, optimal utilisation of resources for the provision of electricity services, establish appropriate consumer rights and obligations regarding the provision of electricity services and monitor the operation of the electricity market.
  • The Commission wishes to invite experienced and competent service providers to submit an expression of interest for the underlisted service.
Eligibility Requirements
Interested firms should submit two (2) bound copies of Eol documents duly signed, paginated, separated by dividers, and arranged in the order outlined hereunder:
  • Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC), including Form CAC,, or CAC, and CAC, Business Name with Form BN1 is also acceptable for Consultancy Services;
  • Evidence of Company's Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificates of all Partners in case of Business Name) for the last three (3) years valid till 31st December 2024;
  • Evidence of Pension Clearance Certificate valid till 31st December 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above);
  • Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder's annual turnover is N50m and above);
  • Evidence of Nigeria Social Insurance Trust Fund Clearance Certificate valid till 31st December 2024;
  • Evidence of Registration on the National Database of Federal Contractors, Consultants, and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
  • Sworn Affidavit disclosing whether or not any officer of the relevant committees of the Nigerian Electricity Regulatory Commission or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
  • Company's Audited Accounts for the last three (3) years - 2021, 2022 & 2023;
  • Reference Letter from a reputable commercial bank in Nigeria, indicating a willingness to provide credit facility for the execution of the project when needed;
  • Company's Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as NAICOM, etc.;
  • Evidence of Firm's current registration with relevant regulatory professional body(ies);
  • Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years, including Letters of Awards, Valuation Certificates, Job Completion Certificates, and Photographs of the projects;
  • Bidders must possess evidence of National Register for Conformity Assessment Practitioners (NRCAP) registration with the Standards Organization of Nigeria (SON);
  • For a Joint Venture/Partnership, a Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner);
Note: All documents for submission must be transmitted with a covering/ forwarding letter under the company/firm's letterhead paper bearing, amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), contact address, telephone number (preferably GSM No.) and e-mail address. The letterhead paper must bear the names and nationalities of the directors of the company at the bottom of the page, duly signed by an authorized officer of the firm.

Closing of Submissions
Tuesday; 26th November, 2024 (12:00 noon).

Submission of Expression of Interest

Interested firms are to submit two (2) bound copies of each of the expression of interest (Eol) documents separated by dividers and arranged as indicated above. The document should be submitted in a sealed envelope addressed to "The Chairman, Nigerian Electricity Regulatory Commission, Plot No. 1387, Cadastral Zone A00, Central Business District, Abuja" and clearly marked with the name of the project. Furthermore, the reverse of each sealed envelope should bear the name and the address of the bidder and dropped not later than 12:00 noon on Tuesday, 26th November, 2024 in the designated Tender Box located at:

Opening of Expression of Interest
  • The Eol documents will be opened immediately after the deadline for submission at 12:00 noon, Tuesday, 26th November, 2024, in the Commission's Hearing Room Wing B, 4th floor, Plot No. 1387, Cadastral Zone, A00, Central Business District, Abuja in the presence of bidders or their representatives.
  • Please, ensure that you sign the Eol Submission Register in the Commission's Registry Unit on the Ground floor, Wing A, as the Nigerian Electricity Regulatory Commission will not be held liable for misplaced or wrongly submitted bids.

General Information
  • Eol must be in English Language and signed by an official authorised by the bidder;
  • Eol submitted after the deadline for submission would be returned un- opened;
  • All costs will be borne by the bidders;
  • All documents must be submitted in both soft and two (2) hard copies;
  • The Eol will be opened in the presence of applicants or their representatives, CSOS in the areas of Anti-Corruption and Transparency and Private Professional bodies;
  • Only shortlisted firms will be invited at a later date for collection of Request for Proposals;
  • The Nigerian Electricity Regulatory Commission is not bound to shortlist any Applicant and reserves the right to annul the procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
