The Benin-Owena River Basin Development Authority (BORBDA) is one of the twelve river basin development authorities established by the Federal Government of Nigeria by an ACT of 1986 which repealed the 1979 river basins development authorities. The Benin Owena River Basin Development Authority covers three states ; Edo, Ondo, Ekiti and one senatorial district in Delta state.

Preamble
The Benin-Owena River Basin Development Authority (BORBDA), hereinafter referred to as "the Authority"), a Parastatal of the Federal Ministry of Water Resources, is desirous of executing her FY2022 Capital Projects. In compliance with the Public Procurement Act, 2007, the Authority hereby invites interested, experienced and competent Consultants/Contractors/Suppliers to submit Expression of Interest (Eol) and bids for the under listed projects.

Eligiblity Requirements

• Evidence of Certificate of Incorporation issued by Corporate Affairs Commission (CAC) including Form CAC1.1 or CAC2 and CAC7. Business Name is also acceptable for Services:
• Evidence of Company's Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificates of all Partners in case of Business Name) for the last three (3) years (2019, 2020 & 2021) valid till 31st December, 2022;
• Evidence of Pension Clearance Certificate valid till 31st December, 2022 (this requirement is only applicable to bidders whose number of staff is 15 and above);
• Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2022 (this requirement is only applicable to bidders whose number of staffis 5 and above or the bidder's annual turnover is N50m and above):
• Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2022;
• Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December, 2022 or valid Certificate issued by BPP;
• Company's Audited Accounts for the last three (3) years (2019, 2020, 2021) duly acknowledged by the Federal Inland Revenue Service (FIRS):
• Sworn Affidavit disclosing whether or not any officer of the relevant committees of the Benin-Owena River Basin Development Authority or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars:
• Reference Letter from a reputable commercial bank in Nigeria indicating willingness to provide credit facility for the execution of the project when needed;
• Company's Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as COREN, COMEG, QSRBN, ARCON, CORBON, ANAN, ICAN etc);
• Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the Projects;
• Works: List of Plants/Equipment with proof of Ownership/Lease;
• For Equipment: Letter of Authorisation from Original Equipment Manufacturers (OEMs):
• For Training: Evidence of Accreditation by Centre for Management Development (CMD):
• For Services: Evidence of the Firm's current Practice Licence issued by the relevant regulatory professional body(ies), e.g. COREN, COMEG, etc;
• Electricity Jobs: Evidence of current Licence issued by Nigerian Electricity Management Services Agency (NEMSA):
• For Joint Venture/Partnership. Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Compliance Certificate, ITF Compliance Certificate, NSITF Compliance Certificate, IRR & Swom Affidavit are compulsory for each JV partner);
• Inclusion of a bid security of 2% of the bid price for Works of Three Hundred Million Naira (N300m) and above; and for Goods and Services of One Hundred Million Naira (N100m) and above;
• All documents for submission must be transmitted with a Covering/Forwarding letter under the Company's/Firm's Letterhead duly signed by the authorised officer of the firm. The company's letterhead must bear amongst others, the Registration Number(RC) as issued by the Corporate Affairs Commission (CAC). The Letterhead must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the firm.

Opening of EOIs and Technical Bids
The Expression of Interest (Eol) will be opened immediately after the deadline for submission at 12:00 noon Monday, 9th May, 2022, in the New Conference Room, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor.

The Technical bids for the Invitation for Pre-Qualification will be opened immediately after the deadline for submission at 12:00 noon Monday, 9th May, 2022, in the New Conference Room, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor.

Only the technical bids for the Invitation to Tender (For Works & Goods) and Non-Consultancy Services will be opened immediately after the deadline for submission at 12:00 noon, Monday, 30th May, 2022, in the New Conference Room, Benin-Owena River Basin Development Authority, km 24, Benin/Sapele Road, Obayantor, while the Financial bids will be kept unopened.

Collection of Tender Documents (Goods & Works)
Interested companies are to collect the Standard Bidding Document (SBD) from the office of Head of Procurement Unit, Room 067, Ground Floor, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor on presentation of evidence of payment of a NON-REFUNDABLE tender fee of N10,000.00 per Lot, paid into the Benin-Owena River Basin Development Authority's Remita account in any reputable commercial bank in Nigeria. Bidders are to generate Remita Retrieval Reference (RRR) and pay into the BORBDA Remita e-collection IGR Account Number 025203800100 in any commercial bank The GIFMIS code for the Tender fees is 1000020623. NOTE: Firms / Contractors for Invitation for Prequalification (LOTS A1 & A2) and Expression of Interest (LOTS D1-D9) are not required to pay any tender fee at this stage

Submission of Bids / EOIs
For Expression of Interest (Eol) interested firms should submit two (2) bound copies Expression of Interest (Eol) documents duly signed, paginated, separated by dividers and arranged in the order outlined in (Eligiblity Requirements) above. The reverse side of each sealed envelope should bear the name and address of the bidder and dropped in the designated Tender Box not later than the specified documents.

Prospective bidders for Invitation for Pre-qualification are to submit Pre-Qualification Documents for each of the Lot desired; two (2) hard copies each of the technical bids packaged in sealed envelopes and clearly marked as "Technical Bid'; with the name of the project and the Lot number. Furthermore, the reverse side of each sealed envelope should bear the name and address of the bidder and dropped in the designated Tender Box not later than the specified closing date.

Prospective bidders for Invitation to Tender (for Works & Goods) are to submit two (2) hard copies each for technical and financial bids with softcopy of the financial
bid only in MS-Excel format: packaged separately in sealed envelopes and marked as "Technical Bid" or "Financial Bid". Thereafter, put the two sealed envelopes together in a bigger envelope and clearly marked with the name of the project and the Lot number at the top right corner. Furthermore, the reverse side of each sealed envelope should bear the name and address of the bidder and dropped in the designated Tender Box not later than the specifiedclosing date.

General Information

• Bids must be in English Language and signed by an official authorised by the bidder:
• The authorised official shall be introduced to the Authority by a Letter of Authority duly signed by the Director and Secretary of the Company:
• Bids submitted after the deadline for submission would be returned unopened;
• Bidders should not bid for more than two (2) Lots;
• All costs will be borne by the bidders; f. Only pre-qualified bidders for Invitation for Pre-Qualification will be invited on a later date for collection of tender documents,
• Only pre-qualified bidders for Invitation to Tender (Works/Goods & NonConsultancy Services) will be invited on a later date for virtual financial bids opening, while the financial bids of unsuccessful bidders will be returned unopened.
• Consultancy Services: Only shortlisted firms will be invited on a later date for collection of Request for Proposals;
• Presence of bidders/representatives and members of the public shall not be required during the bid opening ceremony in compliance with COVID-19 Guidelines. • Bid documents can also be collected in soft copies and Bidders can submit through post (Courier Services). Bids submitted through post must be received before the deadline for submission of bids, otherwise the bid will be returned unopened;
• The Benin-Owena River Basin Development Authority is not bound to prequalify/shortlist any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
